Services Scope

This agreement covers the rental of roll-off dumpsters and portable bathroom units from Budget Dumpsters Company. Services include delivery, placement, scheduled servicing, and final pickup of equipment. Our standard offerings include residential and commercial roll-off dumpsters in sizes from 10 to 40 cubic yards, standard porta-potties, luxury restroom trailers, ADA-compliant portable restrooms, and hand wash stations. Any service not explicitly listed such as temporary fencing, site cleanup, or waste disposal permitting requires a separate written agreement. Excluded from this contract are hazardous materials, including paints, solvents, batteries, tires, and medical waste, as prohibited by U.S. EPA non-hazardous waste regulations and local municipal codes. Street placement of dumpsters may require a permit from the City of Grand Rapids; the renter is responsible for obtaining that permit. OSHA sanitation standard 1926.51 requires sanitary toilet facilities at construction sites with five or more workers; we supply compliant units. All equipment is provided in good working order, and the renter agrees to use it only for its intended purpose.

Scheduling And Cancellations

Appointments are scheduled based on availability and confirmed in writing. Delivery typically occurs within 24 hours of order placement, provided the drop-off location meets our requirements: level ground, a 14-foot overhead clearance, and a 10-foot clearance width. No blocking of fire hydrants or emergency access is allowed. Cancellations must be made at least 48 hours before the scheduled delivery time to avoid a fee. Scope changes such as upgrading to a larger dumpster or adding portable toilets require approval and may adjust the rental period or service interval. Same-day emergency delivery is available for an additional charge; it is subject to route capacity. If the renter fails to provide access or cancels on the day of delivery, a trip charge may apply. Swap-out service for full dumpsters can be requested with 24-hour notice. The company reserves the right to reschedule due to weather or safety conditions without penalty.

Estimates And Payment

Quotes are provided based on the equipment type, rental duration, and estimated weight of debris. Final pricing may adjust if actual weight exceeds the allowance or if prohibited items are discovered during disposal. Payment is due at the time of delivery unless other terms are agreed in writing. We accept major credit cards and electronic transfers. For ongoing construction projects, a deposit may be required, with the balance due upon completion of the final service. Any additional services such as extra pump-outs for portable toilets or extended rental days will be billed after the work is performed. The renter is responsible for all tipping fees and disposal costs associated with the waste stream. If a permit is required for street placement, the permit fee is added to the invoice. Late payments may incur a monthly service charge. All pricing is subject to change with 30 days written notice.

Workmanship Warranty

Budget Dumpsters Company warrants that all equipment delivered is in proper working condition and free from defects at the time of placement. This warranty covers mechanical failures of roll-off dumpster trucks, porta-potty holding tanks, and luxury restroom trailer systems for the duration of the rental period. If a unit fails due to a manufacturing or service issue, we will repair or replace it at no additional cost. The warranty does not cover damage caused by misuse, overfilling beyond the rim line, placement of prohibited materials, or vandalism. Regular servicing such as pump-outs every seven days for portable toilets is included in the rental agreement; failure to allow access for scheduled service voids the warranty. The renter must report any defect within 24 hours of discovery. This warranty is exclusive and replaces all other implied warranties, including merchantability and fitness for a particular purpose.

Liability Limits

The liability of Budget Dumpsters Company is limited to the total amount paid for the specific rental service giving rise to the claim. We are not liable for any indirect, incidental, or consequential damages, including project delays, lost profits, or damage to property caused by pre-existing conditions such as underground utilities, soft ground, or inadequate access. The renter assumes responsibility for preparing the drop-off area and ensuring it can safely support the weight of a loaded dumpster truck. Compliance with OSHA 1926.51, ADA 2010 Standards, and local fire code spacing for restroom trailers is the renter’s duty; we provide equipment that meets these standards but cannot control site conditions. Any claim must be submitted in writing within 30 days of the service date. This limitation does not apply in cases of gross negligence or willful misconduct. Some states do not allow the exclusion of incidental damages, so this limitation may not apply to you.
